IN my days at the private bar, when I did quite a bit of media law, people often came to see me wanting to sue in defamation over something that had been published about them.  


Sometimes I had to explain to them that the defence of fair comment was available for the publication because it seemed to be an expression of opinion on some facts that were set out by the writer. My clients were usually astonished. The idea that they could be attacked in the press without having any legal redress seemed an outrage. This reaction reflects an attitude all too common in Australia. Almost everyone would, if asked, say that they were in favour of freedom of speech. But what they often mean is speech that they do not find offensive in any way. 


There are various statutes that make it unlawful to publish material that is offensive to some groups in the community. One of these is the federal Racial Discrimination Act, which may result in the imprisonment of Frederick Toben, who posted material on the internet arguing that there was serious doubts that the Holocaust occurred. His is an absurd proposition and offensive not only to Jews but to anyone with the least knowledge of modern history. But that is not a reason to prevent Toben from expressing this utterly misguided view. Proceedings were, however, taken against him - successfully - in the Federal Court by the Executive Council of Australian Jewry and in April he was found guilty of contempt, because he had not removed this material from the website where it had been published. 


The sensitivities of a different group were offended in 2002 in Victoria when a number of Islamic converts brought proceedings against a Pentecostal Christian group under a state law that makes religious vilification unlawful. The case ran for five years in tribunals and courts before it was settled on confidential terms.


It is hard to know what the American jurist Oliver Wendell Holmes would have made of all this. Writing a judgment in the US Supreme Court in 1919, he said: "I think that we should be eternally vigilant against attempts to check the expression of opinions that we loathe and believe to be fraught with death, unless they so imminently threaten immediate interference with the lawful and pressing purposes of the law that an immediate check is required to save the country."

Holmes' words do not, however, appear to have sunk in. 


In addition to these Australian examples, the Irish Government announced plans at the end of April to make blasphemy a criminal offence, although presumably confined to attacks on Christian churches. In similar vein, the UN Human Rights Commission has proposed amending the UN Charter to outlaw the criticism of religious beliefs, by which its members essentially mean any criticism of the Islamic creed or its customs.


Earlier this month British authorities detained Philip Nitschke, the Australian voluntary euthanasia campaigner, for nine hours when he arrived in London. No doubt there would be differing views in the community on Nitschke's opinion as to the desirability in some circumstances of a form of suicide (which is itself no longer a criminal offence). But why would the British Government be concerned at anyone hearing those opinions? To quote Holmes again: "The best test of truth is the power of a thought to get itself accepted in the competition of the market." 


Finally, what may seem like a trivial example, but one that perhaps illustrates the all too ready acceptance in this country of a range of restrictions on freedom of speech. In late April, AFL chief Andrew Demetriou said that there would be "zero tolerance" for any public criticism of umpires. Did I miss something here? I thought that umpires, like players, were public performers and fair game for criticism. But Hawthorn president Jeff Kennett was given the option of paying a $5000 fine to the AFL or attending a re-education course with its umpiring department. Kennett chose to pay the fine rather than engage in such a degrading exercise. The truth is that almost all countries have unnecessary restrictions on freedom of speech. The one general exception to this proposition is the US, where a combination of the Constitutional First Amendment and a long history of robust public debate has resulted in the practice of free speech not just its theory. 


The answer in Australia is not a bill of rights, because any right to freedom of speech in such legislation would be contradicted by rights not to be vilified on various grounds. The real answer is to accept that opinions, no matter how offensive to some or all members of the community, should be immune from all civil or criminal proceedings.

           On 28 April 2009 local Adelaide Advertiser newspaper was outside court for a photo opportunity.         

         Out of a selection of photographs, the final one, below,  was used in the newspaper the following day,    

          where Fredrick Töben greets supporters. He is standing in the cafe and a photo tele lense captured     

            his wave. What The Advertiser editor did not state is that this may be a Roman, a Hitler or a              

           Masonic salute - that's left up to the reader to infer! The ABC TV news editor did the same in the      

                                                           16 April 2009 1900 hours news item. Why?

                                          QUESTION: Which is Töben's salute?                                          

 Clue: Notorious Australian solicitor Steven Lewis and barrister Robin Margo could  

    not understand the concept of justice without thinking of Jewish persecution!
