Race hate case heads back to court

AUSTRALIA'S first successful racial hatred prosecution involving the internet will head back to court next week.
Adelaide man Dr Fredrick Töben, who runs the Adelaide Institute website, has lodged an appeal against a Federal Court ruling ordering him to stop publishing material offensive to Jews.
On his web site, Dr Toben had expressed doubt that the Holocaust occurred.
He also said it was unlikely there were homicidal gas chambers at Auschwitz, and that Jewish people who were offended by or challenged Holocaust denial were of limited intelligence.
Federal Court Justice Catherine Branson last month ruled Dr Töben acted illegally by publishing the claims.
He was ordered to remove the material from his website but at the time said he would not stop telling the 'truth' and did not rule out serving time in jail for doing so.
Dr Töben, who spent seven months in a German jail for inciting racial hatred and defaming the memory of the dead, indicated he would appeal the ruling when the judgment was handed down.
The case will return to the Federal Court in Sydney on October 30.__________________________________________________
