Zündel Appeal Rejected by Bundesgerichtshof (Federal Appeals Court)

Gegen das Urteil des Landgerichts Mannheim, womit Ernst Zündel zur Höchststrafe für politisch nicht genehme Äußerungen zur Zeitgeschichte von 5 Jahren verurteilt wurde und ferner festgestellt wurde, daß 2 Jahre vorherige Haft in Kanada, die seiner Abschiebung dienten, nicht angerechnet wurden, ist durch mich und andere Verteidiger Revision eingelegt worden.

I am one of several defense attorneys who appealed the verdict of Mannheim District Court, in which Ernst Zündel received the maximum sentence for making politically undesirable utterances.

That verdict also stated that Mr. Zundel’s two years of confinement in Canada while awaiting extradition would not be taken into consideration.

 

Diese ist mit Beschluß vom 12.09.2007 verworfen worden.

Our appeal was rejected by the Bundesgerichtshof (Appeals Court of the Federal Republic) on 12 September 2007.

 

Dies, obwohl es eine ganze Reihe von offensichtlichen absoluten Revisionsgründen gegeben hat, die vom BGH nicht beachtet worden sind.

The BGH refused to consider the appeal, even though there were numerous grounds for appeal that were obvious and absolute.

The BGH chose to ignore all of them.

 

Der BGH erwähnt nur zwei Punkte.

The BGH mentioned only two points.

 

Einmal, daß ich über 20 Aktenbände nicht in meine Kanzlei übersandt bekam, so daß ich keine Kopien fertigen konnte und nur in der Geschäftsstelle des Landgerichts Mannheim hätte einsehen dürfen, was der BGH für in Ordnung befindet, obwohl die allgemeine Übung eine andere ist.

One was that my office did not receive more than 20 volumes of documents, with the result that I was unable to make copies of them.

This means that I would not have been able to examine the subject documents anywhere except the business office of Mannheim District Court.

The BGH considered this to be nothing out of the ordinary, despite the fact that it is totally out of compliance with established practice.

 

Sodann wird nur mit einem kurzen Satz gesagt, daß die Verweigerung der Anrechnung der 2 Jahre Haft in Kanada rechtsfehlerfrei zustande gekommen sei.

In a single terse sentence, the BGH stated that Mannheim Court’s refusal to consider the two years confinement in Canada did not constitute legal error.

 

Damit ist ein Urteil rechtskräftig geworden, das aufgrund eines Verfahrens zustande gekommen ist, das geradezu beispiellos in der Bundesrepublik ist.

Thus the BGH upheld a verdict that had been pronounced in a trial that was absolutely without precedent in the Federal Republic.

 

Die krassesten Mängel, die auf der Hand liegen, werden nachfolgend kurz dargestellt:

Following are some of the more crass deficiencies and irregularities that occurred during the Mannheim trial:

 

1. Das gesamte Verfahren zeichnete sich dadurch aus, daß die Öffentlichkeit lediglich von den Vorwürfen einige Sätze, die in der Anklageschrift zitiert worden waren, erfuhr.

2. The entire trial was characterized by the fact that the public was informed of only a few sentences from the list of complaints quoted in the indictment.

 

Diese waren oftmals aus dem Zusammenhang gerissen, teils handelte es sich nur um Halbsätze, oder sie waren durch Auslassungen im Sinn verändert.

These sentences were taken out of context, or half the sentences were missing, or their import was altered by omission. 

Wie der Zusammenhang war, erschloß sich nur demjenigen, der den mehreren hundert Seiten umfassendem Band “Selbstleseverfahren“ las; der Öffentlichkeit wurden die Zusammenhänge vorenthalten.

“The picture is rounded out by Dr. Meinerzhagen’s procedural disposition announced on 16 February 2006  concerning Selbstleseverfahren, the introduction of the collected texts of Ernst Zündel into the main proceedings.  The court wants a “ghost trial,” a show trial carried out through secret proceedings, in which the public can learn absolutely nothing about what is really going on.”]

The relevance would be known only to someone who had read the volume “Selbstleseverfahren,” which consisted of several hundred pages – it was not made known to the public.

 

2. Dieses Selbstleseverfahren wurde dann noch während der Hauptverhandlung ausgedehnt, wobei dies mir – weil ich an dem fraglichen Tag nicht anwesend war – nicht mitgeteilt wurde.

2. This Selbstleseverfahren (secret introduction of Zündel’s collected texts) was then extended into the main proceedings, which was not made known to me, as I was unable to be present on the day it was read.

 

Ich wußte dies also gar nicht, kannte auch gar nicht die Dokumente, die dann zusätzlich im „Selbstleseverfahren“ eingeführt wurden.

Thus I knew nothing about it -- I was not even familiar with the documents, which were introduced into the Selbstleseverfahren.

 

Ich habe deswegen dazu natürlich auch keine Beweisanträge machen können und in meinem Plädoyer auch darauf nicht eingehen können.

This meant that I was unable to introduce evidentiary motions and was unable to include the matter in my pleading. 

 

Obwohl jedem Prozessbeteiligten die Dokumente, die im Selbstleseverfahren eingeführt werden, zwingend zugänglich gemacht werden müssen, spielte das in meinem Falle keine Rolle.

Although legal proceddure requre that documents and materials introduced in Selbstleseverfahren must be made available to every trial participant, the Court did not do so in my case.

 

 Im Urteil werden mithin Schriftstücke dem Angeklagten vorgeworfen, von denen ich gar nicht wußte, daß sie Gegenstand des Prozesses und der Urteilsbegründung werden würden.

Consequently the verdict makes accusations against the defendant concerning written documents of which I had no knowledge whatsoever.

I had no way of knowing they would become part of the trial and part of the basis of the verdict.

 

3. Als die Verteidiger Dr. Schaller und ich begannen, umfangreiche Beweisanträge zu stellen, wurde ihnen verboten, diese noch mündlich vorzutragen; sie mußten schriftlich eingereicht werden.

3. When Defense Attorney Dr. Schaller and I began making extensive motions for evidence we were not allowed to present them orally; they had to be submitted in written form.

 

Anschließend wurde beiden Verteidigern dann zusätzlich verboten, Gegenvorstellungen gegen Beschlüsse der Kammer, die die Beweisanträge abgelehnt hatten, mündlich vorzutragen; auch diese mußten schriftlich eingereicht werden.

In addition to this, both the attorneys for defense were also forbidden to submit oral counter-statements against the rulings of the court denying the evidentiary motions: these too had to be submitted in written form.

 

Sodann wurde beiden Verteidigern eine Frist von einer Woche gesetzt, in der sie noch weitere Beweisanträge einreichen dürften.

Then the court set a limit of one week for both defense attorneys in which they would be allowed to submit additional evidentiary motions.

 

Hinsichtlich der anschließend eingereichten Beweisanträge sei die Kammer nicht verpflichtet, diese in der Hauptverhandlung auch zu bescheiden; eine Bescheidung erfolge im Urteil.

With regard to the accompanying evidentiary motions submitted, the Court announced that it was not obligated to rule on these during the main proceedings.

They announced that a pronouncement would follow in the verdict.

Damit war es der Verteidigung nicht möglich, sich auf eine ablehnende Begründung der Kammer einzustellen und gegebenenfalls über eine Gegenvorstellung oder einen ergänzenden Beweisantrag dem Angeklagten zu helfen.

This made it impossible for the Defense to respond to a reason for  rejection.

It made it impossible also to present a counter statement or supplementary evidentiary motion to assist the defendant.

 

Dies ist ein krasser Verstoß gegen die Strafprozessordnung, weil danach bis zum Schluß der Beweisaufnahme Beweisanträge durch die Verteidigung gestellt werden können, die dann auch von der Kammer beschieden werden müssen; sogar wenn neue Beweisanträge anschließend gestellt werden, muß die Kammer erneut in die Beweisaufnahme eintreten, und dazu Beschlüsse verkünden.

This the court’s refusal to rule on evidentiary motions is a crass violation of criminal procedure.

According to criminal procedure, evidentiary motions by the Defense can be allowed until the conclusion of the evidence acceptance phase of the trial, and the Court must then rule on them.

If new evidentiary motions are presented, the Court has to enter anew in the acceptance of evidence and announce its rulings.

 

4. Als ich zu elf ablehnenden Beschlüssen, die auf Beweisanträge von mir ergangen waren, Gegenvorstellungen machen wollte, gab mir der Vorsitzende dafür eine Zeit von 15 Minuten.

4. When I wanted to submit Remonstrances to eleven rulings of disallowance of my evidentiary motions, the presiding judge allowed me 15 minutes for this purpose.

 

Ich beantragte Gerichtsbeschluß dazu, woraufhin mir die Kammer dann die Zeit um 15 Minuten verlängerte, insgesamt also 30 Minuten gab.

I then moved adjournment of the court in so that I would have time to accomplish this, whereupon the Court increased my allowable time to 30 minutes.

 

Dies bedeutete für jede Gegenvorstellung eine Zeit von unter 3 Minuten.

This meant that I was allowed less than 3 minutes for each remonstrance.

 

Da mir auferlegt worden war, alle Gegenvorstellungen nur schriftlich einzureichen, bedeutete dies, daß ich in einer Zeit von unter 3 Minuten meinen Beweisantrag mit dem ablehnenden Beschluß des Gerichtes vergleichen mußte, sodann schriftlich dazu meine Bedenken darlegen mußte.

Since it had been imposed on me to present all remonstrances in writing, this meant that I had to compare my evidentiary motion with the rejection ruling of the Court in a period of less than three minutes and then present my thoughts in writing as well.

 

Es liegt auf der Hand, daß dies technisch unmöglich ist.

It goes without saying that this is impossible.

 

Damit war klar, daß den Richtern völlig gleichgültig war, was der Angeklagte oder die Verteidigung vortrug; sie hatten auch vorher schon x-mal gezeigt, daß sie an einem fairen Verfahren kein Interesse hatten, und machten dies nun offensichtlich.

Such crassness made it very clear that the judges were totally indifferent to anything the accused or his defense presented.

On numerous occasions they had indicated that they were not concerned with conducting a fair trial; now they made this perfectly obvious.

 

Daraufhin erfolgte ein Befangenheitsgesuch gegen die Mitglieder der Kammer.

Then followed our Befangenheitsgesuch (petition on account of the bias of the members of the Court.)

 

Sowohl Generalbundesanwalt wie auch der BGH haben diese Richter aber nicht als befangen angesehen, sondern störten sich an diesem Vorgehen der Richter nicht.

The Generalbundesanwalt (Federal Attorney General) as well as the Bundesgerichtshof (Federal High Court) did not consider these judges biased, however.

They found nothing objectionable in their conduct.

 

Mit anderen Worten: Verteidiger sind in solchen Prozessen nur Staffage; auf das Urteil haben sie keinen Einfluß.

In other words:  attorneys for the defense in such show trials are merely window dressing, and they have no influence on the verdict.

 

5. Die Kammer hat in einem Beschluß gerügt, daß der Angeklagte angeblich die zutreffenden Opferzahlen von Auschwitz bezweifle.

5.  In one ruling, the Court reprimanded the accused for allegedly questioning the proper number of Auschwitz victims.

 

Seitens der Verteidigung war deshalb angefragt worden, und zwar mit Rücksicht auf die vielfach unterschiedlichen Zahlen, die in der Literatur an Auschwitzopfern genannt werden, welches denn nach Auffassung der Kammer die richtige Opferzahl sei.

Regarding the extreme range of estimates quoted in the literature on Auschwitz, the defense had specifically asked which number of victims was the correct number, in the opinion of the court.

 

Daraufhin teilte die Kammer dem Angeklagten und der Verteidigung mit, daß sie eine solche Zahl nicht bekanntgeben werde, da es darauf nicht ankomme; nicht wegen der Opferzahl, sondern wegen der Leugnung des Holocaustes als ganzem durch Bezweiflung der Gaskammern käme eine Bestrafung in Betracht.

The Court informed the accused and his defense that they would not be informed of any such number.

The Court stated that the number of victims was not important, but rather the accused’s denial of “Holocaust” in its entirety.

The accused had committed “Denial” by questioning the existence of homicidal gas chambers, that was the reason why the Court was considering his punishment.

 

Daraufhin hat die Verteidigung zu den Opferzahlen in verschiedenen Konzentrationslagern natürlich keine Beweisanträge mehr gestellt.

After that, the Defense of course made no more evidentiary motions concerning the numbers of alleged victims in the various concentration camps.

 

Im Urteil ist der Angeklagte dann durch dieselbe Kammer verurteilt worden, weil er angeblich zu niedrige Opferzahlen im Konzentrationslager Auschwitz genannt hat.

In the verdict, the accused was sentenced by the same Court for allegedly stating an inadequate number of victims of Auschwitz Concentration Camp.

 

6. Dem Urteil und den Akten ist zu entnehmen, daß die Webseite „Zundelsite“ im Mai 1996, März 1998, August 1998 durch Staatsanwaltschaft bzw. Kriminalbeamte überprüft worden ist, das Verfahren im August 1998 gegen den Angeklagten wegen Abwesenheit eingestellt wurde (weil er in Kanada lebte und sein Verhalten dort nicht strafbar war), nach seiner Verhaftung in den USA wegen angeblichen Passvergehens am 5.2.2003 der Staatsanwalt Klein am 16.2.2003 wiederum ins Internet sah, am 17.2.2003 das Verfahren wieder aufgenommen wurde und am 20.2.2003 der Inhalt der „Zundelsite“ durch das BKA gesichert wurde.

6. From the verdict and court documents, we learn that the district attorney and criminal officials had investigated the Zündel website in May 1996, March 1998 and August 1998.

We also learn that they discontinued proceedings against Zündel in August 1998 on account of his absence; he was living in Canada, where his actions were not punishable there.

 Following his arrest in the USA on 5 February 2003 for an alleged passport violation, District Attorney Klein again searched the Internet, resuming proceedings on 17 February 2003.

He downloaded the contents of the Zündel site on 20 February 2003.

 

Dem Urteil ist ferner zu entnehmen, daß das Dokument „Holocaust 101“ im August 1998 noch nicht auf der Zundelsite war, aber am 16. und 20.2.2003 dort festgestellt wurde.

From the verdict we also learn that the document “Holocaust 101” was not yet present on the Zündel site in August 1998, but was there on 20 February 2003.

 

Zur Zundelsite finden sich im Urteil zahlreiche widersprüchliche Angaben:

One finds numerous self contradicting allegations regarding the Zündel website in the verdict:

 

mal soll der Angeklagte daran mitgewirkt haben, mal soll er Hauptverantwortlicher gewesen sein, mal ist von „Ingrids Zundelsite“ die Rede, mal wird Frau Dr. Rimland als diejenige, die lediglich die technische Arbeit mache, wogegen der Angeklagte den Inhalt bestimme, geredet.

Sometimes Zündel is said to have participated in its creation; sometimes he is said to have had primary responsibility; sometimes the website is referred to as “Ingrid’s website;” sometimes Dr. Rimland is depicted as the one who performs the technical tasks alone while the Zündel determines the content.

 

Ausweislich des Urteils wurde der Angeklagte zu einer Freiheitsstrafe von 3 Jahren wegen des Internetauftritts verurteilt, wobei als beanstandenswert hinsichtlich der Internetseite insbesondere die Schrift „Starben wirklich 6 Millionen?“ und das Dokument „Holocaust 101“ genannt werden.

The verdict states that the accused was sentenced to a prison term of three years on account of his Internet activities, specifying complaints about the publication “Did Six Million Really Die?” and the document “Holocaust 101.”

 

Hinsichtlich des letzteren Dokumentes läßt sich aber überhaupt nicht feststellen, wann es auf die Seite kam; wenn es beispielsweise am 10.2.2003 auf die Seite gekommen sein sollte, was die Kammer nicht ausschließen kann, wäre dies während der Haftzeit des Angeklagten passiert, wo er keinerlei Einflußnahme schon aus tatsächlichen Gründen auf die Internetseite haben konnte.

Regarding “Holocaust 101,” it cannot be determined when this document was placed on the website.

If for example it was first placed there on 20 February 2003, as the Court cannot rule out, this would have been a time when the accused was already under arrest -- a time when he in fact had no access to or influence over the website.   

 

Die Kammer unterstellt also eine strafrechtliche Verantwortlichkeit, obwohl sie überhaupt nicht weiß, ob der Angeklagte überhaupt darauf Einfluß nehmen konnte.

Thus the Court has made the accused answerable for a crime even though it does not know whether the accused exerted influence on the allegedly unlawful deed.

 

7. Aus den Akten ergab sich ein intensives Zusammenspiel zwischen den deutschen Behörden und den kanadischen Behörden, damit der Angeklagte nach Deutschland abgeschoben würde.

7. From the documents we also learn of intensive collaboration between German and Canadian officials in extradicting the accused to Germany.

 

Andere Länder, die keine Strafbarkeit von „Holocaustleugnung“ kennen, hätten ihm Asyl gewährt, so daß er dort hätte in Freiheit leben können.

Countries that do not consider “Holocaust Denial” a crime would have granted him asylum, and he could have remained there free of persecution.

 

Er wurde mit Kosten von über 100.000 $ in einer Privatmaschine von Kanada nach Deutschland geflogen, wohingegen der Spionage verdächtige Ausländer lediglich in ein Linienflugzeug ihrer Wahl gesetzt werden, da es Kanada schließlich gleichgültig sein kann, wo sie landen: Hauptsache, sie sind weg.

Zündel was flown from Canada to Germany in a private aircraft at a cost of $100,000, whereas foreigners suspected of espionage are simply transported in an airplane of their choosing, since Canada has no interest in where they land as long as it is not in Canada.

 

Nur aus „Opportunitätsgründen“ war kein Auslieferungsersuchen an Kanada gestellt worden, weil die kanadischen Behörden den deutschen Behörden zugesichert hatten, daß nach den neuen Terrorismusgesetzen, die nach dem 11. September 2001 ergangen waren, es leichter sei, Zündel nach Deutschland zu verbringen.

For “opportunistic reasons”, Germany had made no extradition request to Canada.

This was because Canadian officials had informed German officials that, under the new terrorism laws adopted following 11 September 2001, it would be easier to deliver Zündel to Germany. 

 

Das kanadische Verfahren war ein Geheimverfahren, wo weder dem Verteidiger noch dem Betroffenen Ernst Zündel Zeugenaussagen oder Dokumente zugänglich gemacht wurden, zahlreiche von ihm benannte Zeugen nicht gehört wurden, so daß irgendeine Verteidigungsmöglichkeit nicht gegeben war.

The Canadian operation was secret.

Zündel was given no opportunity to defend himself since neither he nor his attorneys were made aware of the documents and statements of biased witnesses that were used against him.

His own witnesses were not allowed to testify on his behalf.

 

Die Mannheimer Richter waren trotzdem der Meinung, daß die Entscheidung des kanadischen Richters Blais korrekt zustande gekommen sei, obwohl erst ein Obergericht – noch während des laufenden Prozesses – und nach Ergehen des Urteils auch das höchste kanadische Gericht das ganze Verfahren, nach dem der Angeklagte abgeschoben wurde, als verfassungswidrig bezeichnet haben.

The Mannheim judges were of the opinion that the decision of the Canadian judge Blais was correct, even though a Canadian appeals court declared, while the Zündel trial was still under way, that the trial was in violation of the Canadian constitution.

After his verdict was pronounced and he had been transported to Germany, the supreme court of Canada also declared the entire operation to be in violation of the Canadian constitution.

 

Das war für niemanden, der auch nur oberflächliche Rechtskenntnisse hat, verwunderlich.

However, the actions of the government are surprising to no one who is the least familiar with legality and law.

 

Die Gesetze brachen mit einer 400jährigen angelsächsischen Rechtstradition.

The new terrorism laws have broken with a 400 hundred year old Anglo Saxon legal tradition.

 

Obwohl es sich weitgehend um ein Geheimverfahren handelte, war aus der Anschuldigungsschrift des kanadischen Geheimdienstes schon ersichtlich, daß der entscheidende Grund für Zündels Abschiebung sein Revisionismus war.

Although it was a secret operation, it was already obvious from the charges listed by the Canadian CIA that the decisive reason for Zündel’s extradition was his revisionist political activities.

 

Es wird ihm vorgeworfen, einer der weltweit führenden Holocaustleugner zu sein und die deutsche Regierung zu destabilisieren, indem er seine revisionistischen Thesen nach Deutschland verbreite.

He is accused of being one of the world’s foremost deniers of “Holocaust” and of destabilizing the present German government by disseminating revisionist theories.

 

Da die Sicherheit Kanadas von der Sicherheit verbündeter Staaten abhängig sei, destabilisiere er damit auch die Sicherheit Kanadas.

Since the security of Canada is dependent on the security of allied countries, the Canadian CIA reasoned that he was thereby destabilizing the security of Canada as well.

 

Es wird ihm Zusammenarbeit mit dem Holocaustleugner Althans vorgeworfen und daß er die Propaganda nationaler Gruppen in Deutschland finanziere.

They accused him of collaborating with “Holocaust Denier” Althans and of financing propaganda of nationalist groups in Germany.

 

Mit seiner revisionistischen Propaganda stachele er zum Hass gegen Juden auf – dieselben Vorwürfe wurden ihm in Deutschland gemacht.

They claimed that with his revisionist propaganda he was inciting hate against the Jews -- the same accusations made against him in Germany.

 

Anders als andere Betroffene nach den s. g. „Terrorismusgesetzen“ wurde Zündel nicht auf Kaution auf freien Fuß gesetzt, weil Sinn und Zweck der Maßnahme war, ihn nach Deutschland abzuschieben.

In contrast to others accused under the so called “terrorism laws,” Zündel was not released on bail.

This was because the whole point of the operation was to transport him to Germany.

 

Trotzdem wurden seine 2 Jahre Haft in Kanada nicht angerechnet so daß er im Endeffekt für eine nach Auffassung des Gerichtes falsche historische Meinung 7 Jahre Freiheitsstrafe bekommen soll.

The Mannheim court refused to acknowlege his two years of solitary confinement in Canada.

The end effect is supposed to be that Zündel will be imprisoned for seven years on account of historical opinions that the Mannheim court considers incorrect.

 

Und dann stellt sich Frau Merkel hin und kritisiert Putin, die chinesische Führung, den Iran und welche Staaten sonst noch deswegen, weil bei ihnen angeblich die Meinungsfreiheit nicht hinreichend gewährleistet sei!

And yet our Frau Merkel stands up and criticizes Putin, the Chinese leadership, Iran and assorted other countries because they supposedly do not allow sufficient freedom of opinion!

 

In allen diesen Ländern gibt es mehr Meinungsfreiheit und mehr Rechte für Personen, die diese Meinungsfreiheit ausdrücken wollen, als in der BRD!

In every one of these counries there is more freedom of opinion and more rights for individuals to make use of that freedom than in the Federal Republic of Germany!

 

8. Meine Revisionsbegründung hat – da die ganzen übergangenen Beweisanträge mit eingearbeitet werden mußten – einen Umfang von über 600 Seiten.

8. My grounds for appeal, since all the evidentiary motions had to be worked into them, cover more than 600 pages.

 

Die Stellungnahme der Staatsanwaltschaft Mannheim dazu ist mir nicht zur Kenntnis gebracht worden.

I have not been informed as to the position of the District Attorney of Mannheim concerning my grounds for appeal.

 

Die Stellungnahme des Generalbundesanwaltes ist mir übersandt worden, wobei allerdings eine Seite fehlte.

The Federal Attorney General  has sent me his statement of position, although there is a page missing.

 

Die Verteidigung hat das Recht, zur Stellungnahme der Staatsanwaltschaft und der Bundesanwaltschaft eine „Gegenerklärung“ abzugeben.

The defense has the right to deliver a “Gegenerklärung  (counterstatement) rebutting the position of the District Attorney General and Federal Attorney General.

 

Dies kann natürlich nur erfolgen, wenn sie bekannt ist.

Obviously this can take place only if the defense knows that position.

They would also have had to send me the Mannheim District Attorney’s statement of position concerning my appeal, along with the demand that they state their position within two weeks, since I had already complained of this in my position statement of 5 September 2007.

Prof tells of battle with David Irving

Thursday, 20 September 2007   VANCOUVER — When her book Denying the Holocaust: The Growing Assault on Truth and Memory was published in 1994, Prof. Deborah Lipstadt devoted 300 words to David Irving, whom she called “the most dangerous of Holocaust deniers, an anti-Semite and racist.”

“The reason is that he knew the truth but distorted it,” Lipstadt, director of Emory University’s Institute for Jewish Studies, told attendees at the Greater Vancouver Jewish Federation’s Combined Jewish Appeal opening night event on Sept. 6.

The venue, Schara Tzedeck Synagogue, was filled to capacity with those who came to listen to her talk, “Truth on Trial: My Day in Court with a Holocaust Denier.”

But Lipstadt’s time in court with Irving went on much longer than a day – it lasted six years.

It all started after Penguin published her book in the United Kingdom. Shortly thereafter, Lipstadt learned that Irving was planning to sue her for libel.

“This is a man who testified as a witness on [German Holocaust denier] Ernst Zundel’s behalf, and who called the Holocaust a legend,” she says. “It seemed, at the time, ludicrous that he could sue me for not being a Holocaust denier.”

What she didn’t know back then was that in the United Kingdom, libel laws are precisely opposite to those in the United States.

Under English libel law, the burden of proof is on the defendant rather than the plaintiff, meaning the onus is on the author of a statement to prove the truth of what he or he she is saying.

“Irving had waited for the book to appear in the U.K. before suing me – in essence, he had venue-shopped,” she said.

Realizing that she would need to fight, Lipstadt hired Anthony Julius, senior consultant for the London law firm Mishcon de Reya and a prominent British lawyer and academic. Best known for his actions on behalf of the late Diana, Princess of Wales, Julius is also known for his opposition to anti-Semitism, and he offered to work on Lipstadt’s case pro bono.

Julius promised her that he would fight the case as vigorously as any commercial case.

“Also, we wanted to ensure this did not become a ‘did-the-Holocaust-happen’ case, and instead focus on proving I told the truth when I wrote that Irving was a Holocaust denier and anti-Semite,” Lipstadt recalled.

“We decided that if the case went to trial, we would not call Holocaust survivors to the stand, because they were witnesses of fact, and we didn’t think it was ethical or necessary to subject a survivor to that.”

Lipstadt, Julius and their team began investigating Irving’s assertions regarding the Holocaust, tracing his footnotes back to the original documents from which he claimed they originated.

“We found distortions over and over again, creating a false impression in reader’s minds, but in a way that sounded credible if you didn’t know the details,” Lipstadt said.

All through the trial, she wondered what would happen if  she lost, or even if she won a “yes, but” victory over Irving. She also received tremendous support from Jews around the world.

“People would come up and tell me how much they were counting on me,” she said. One Holocaust survivor approached her after the first day of the trial. “You are fighting for us. You are our witness,” she said.

Another time, a British man came up to her, explaining that he had helped liberate Bergen Belsen. “Get that bastard,” he told her.

“I felt guarded by this band of people whose life had been shaped by the Holocaust,” she said. “And ultimately, we won a tremendous victory in which the judge laid waste to Irving’s reputation, finding him to be a Holocaust denier, a falsifier of history, a racist, an anti-Semite and a liar.”

Israel, Iran Cooperate in Crash Probe

PHUKET, Thailand (AP) — Officials from Israel and Iran put aside political animosity Tuesday to work together in using Israeli forensics expertise to identify their dead from the crash of a jetliner on this Thai resort island.

A Thai aviation official, meanwhile, revealed that half of the Phuket airport's wind-shear warning devices were not working at the time of Sunday's crash. He said the outage could have contributed to the disaster.

Six Israelis and 18 Iranians were among the 89 people killed when the One-Two-Go Airlines jet crashed and burned while trying to land in heavy rain and wind carrying 130 passengers and crew.

Relations are minimal and tense between the Jewish state and the Islamic Republic — whose president once denied the Holocaust — but diplomats from both nations shrugged off any suggestion the antagonism would hinder efforts to help grieving families.

"It's human nature to help in solving this problem as soon as possible," Safdar Shafiee from the Iranian Embassy in Bangkok said after shaking hands with Yaki Oved, head representative of Israeli police in Southeast Asia and the Pacific.

"In situations like this you forget the division," Oved said. "The main thing is to help. You don't think about the politics."

Shafiee said 15 of the dead Iranians had been identified, but fingerprints or DNA samples to be sent from relatives in Iran would be needed to try to identify the remaining three.

"He told our delegation how they were worried about their missing. I told him we can help him," Oved said, referring to an Israeli forensics team that came to Thailand.

The team, from an emergency rescue service, has long experience in dealing with victims of traumatic injuries from the decades of Arab-Israeli conflict. It will try to match bodies with dental records, fingerprints, DNA and distinguishing features described by relatives.

"We always are willing to help people in need, and it includes, I guess, the Iranians also," said Lior Weintraub, spokesman for the Israeli government delegation in Phuket.

Shafiee, the Iranian official, said it was natural for people to work together after a humanitarian disaster. "I think there is no difference between the humans. All of them are humans and every nation can give any help that they can," he said.

Investigators have said wind shear — a sudden change in either wind speed or direction in an aircraft's flight path that can destabilize a plane — was among the possible causes of the crash.

Vuttichai Singhamanee, director of the flight standards bureau of Transport Ministry's Aviation Authority Department, said Tuesday that half of the airport's solar-powered wind-shear sensors weren't operating because they ran out of stored power during the overcast weather.

"Three out of six low-level wind shear alert systems were not working at the time," he said.

Vuttichai said that could have made it difficult for the Indonesian pilot, Arief Mulyadi, to judge whether it was safe to land. Officials earlier had said only that the control tower warned the pilot of wind shear.

Kajit Habnanonda, president of Orient-Thai Airlines, which owns One-Two-Go, already pointed to wind shear as a possible factor and on Tuesday he defended the pilot — who died in the crash — as "one of our best."

"He was very experienced, patient and very decisive," Kajit told The Bangkok Post.

"The Bitch in the Ditch" vs. "General Betray Us"

When I joined the trenches -- or rather the ditches -- of Camp Casey in mid-August of 2005, there was no political reaction to the abuse already being heaped upon Cindy Sheehan.  The Senate that just Thursday condemned the free expression that Bush's general would betray us was silent when the rhetoric ran the other way.  The TV talking heads who now universally decry the choice of words by the left had no problem when the right used much more choice words to attack the peace mom.

Grieving for her lost son, she had lain down in front of the presidential ranch in Crawford, as devastated as Job, demanding a simple answer to a simple question: Why?  It was not dignified grief -- if there can be such a thing -- but neither was it deranged.  Nevertheless, Sheehan was reviled as "the bitch in the ditch" by the rigid right.  She was decried as a new Hanoi Jane Fonda who was trying to trip the nation up as it planted its feet firmly from Afghanistan to Iraq.  She was said to be betraying our national destiny to bestride the Muslim world like a conquering Judeo-Christian Colossus.  Her marriage and family circumstances were dredged up and poured out in public.

With all the reporters running around in Crawford during that summer vacation, it's peculiar that they missed the story of the right-wing counterattack against the peaceniks at Camp Casey.  It happened on Saturday, August 27, in a well organized pincer movement of buses from both coasts, filled with self righteous Republican shock troops.

I had been attending Crawford protest events since August, 2003, the first summer of the Iraq war.  I was well accustomed to counter protests, as well as to the resentment of some of the Crawford locals who were conducting a lively business for pilgrims to the Western White House.  The anti-Sheehan crowd wasn't anything like a counter protest, though, nor was it merely resentful.  It was a riot waiting to happen.

Robert Noe was there, the perfect picture of a Bush League thug.  History is fortunate to have the candid memoir of the former Green Beret, who boasts of having led a "hatchet platoon" (widely accused of atrocities) in Vietnam.  His "patriotic" actions in Crawford included running around in search of pro-peace traitors.  He screamed and gestured obscenely at the Camp Casey crowd; later he cursed the Crawford Peace House; and later still he called out a busload of peaceniks to fight.  Most of the time he carried an American flag, as if his conduct represented it; but he found this frustrating as the people he was accusing of treason were constantly applauding it.  Those who claim that the left is stooping low with its rhetoric should read his "Anti- Anti War Cidny (sic) Protest" http://www.macvsog.cc/anti-anti_war_cidny_protest.htm

Many self-styled heroes like Captain Noe came to do battle for the glory of global war that day.  Several dozen stood at the main crossroads of the town, waving flags when their partisans drove by, and shooting fingers when their opponents did.  Clusters of bullies picked fights where ever they saw the antiwar gathering, no doubt emboldened because the antiwar shrugged it off and refused to fight.

I was born and raised in Texas, and have to admit that I hadn't seen a crowd anything like this pro-war mob since the Houston race riots of the 1970s. Candidly, until that weekend, I never knew that a group made up mostly of Yankees could imitate the worst side of us southern rednecks so well.  The national media, Bush's camp followers in Crawford, sanitized the unsavory traces of neocon neofascism from the picture, and presented the story without telling it at all -- which has become the hallmark of the contemporary journalistic art.

By Sunday, Aug. 28, their forces had left the field after their one-day foray, and Camp Casey continued with pick-me-up appearances by the likes of Joan Baez and Charlie Sheen.  Having withstood the assault, the antiwar side was stronger after the challenge than it had been before it.  Under siege throughout his summer vacation, King George had avoided the field of battle and kept to his Crawford Castle, like Peter Pan in Neverland.  He never did answer Cindy Sheehan's challenge to tell her why her son had died.  He couldn't, of course, because by 2005 he had already offered a variety of contradictory reasons for the war, all of them repeated mindlessly to a semi-conscious public by a parrot press.  His reticence turned out to be good practice, since he spent the next week keeping mum as New Orleans drowned from Katrina and a military/mercenary crew practiced martial law on the victims.

"Give My Chance a Plan"

"And so, what Gen. Petraeus is saying, some early signs, still dangerous, but give me -- give my chance a plan to work." -- George W. Bush

Without a doubt, George W. Bush is the dumbest president in US history.  His critics debate whether his mind is congenitally afflicted or self-impaired by decades of alcohol and drug abuse.  Our opinions are unspeakable to the mainstream media, of course.  In times of tyranny, unspeakable opinions tend to be correct ones.

Our cheerleader in chief couldn't have picked a better representative of his unsavory character than General David Petraeus, who I think was quite aptly termed "General Betray Us" by MoveOn.org in a full-page ad, published Sept. 10 in the New York Times.  Bush knew that he could count on his general to make the best case for a war that is ever growing worse.  After all, the general had done it before. In 2004, just days before the presidential election, Petraeus published "Battling for Iraq" in the Washington Post, an op-ed lauding Bush's Iraq war pooh-pooh as if it were shoe polish.  Bush had every reason to be confident when he ordered the same Petraeus to give the same pooh-to-polish effort, this time to a sold-out House and a sold-out Senate.

The mainstream media made the most it could out of the general's song and dance routine, and strenuously avoided covering his flaws.  They glossed over his slip of saying that he did not know whether the Iraq war was making the United States any safer.  They didn't repeat the unkind remarks of his superior, CENTCOM Commander Admiral William Fallon, who had called him "an ass kissing little chicken shit."  They conveniently forgot about the suspicious death of the West Point ethics professor, Colonel Ted Westhusing, serving under Petraeus in Iraq, who had been shot in the head after confronting the general for careerism and the mercenary USIS corporation for corruption.  They downplayed the fact that two of the seven Iraq war noncoms who co-authored an Aug. 19 New York Times anti-surge op-ed, "The War As We Saw It," were killed on the very day that Petraeus came before Congress.

In the two weeks since Petraeus brought his sorry show to Washington, the Democrat-led Senate has shown that its character is about the same as the general's.  They have betrayed us, too.  They have failed in their faint-hearted attempts to extract our country from the quicksand war in Iraq.  They have failed to throw down the gauntlet by forcing pro-war Republicans to filibuster in order to continue a lost war.  In fact, they have succeeded in only one thing, and that is much to their shame:  by a vote of 72-25, they condemned the General Betray Us ad.  I hope and believe that their cowardice will backfire on them.  Donations to MoveOn.org have skyrocketed recently, and many Americans are having a hard time getting the general's name right.  Yesterday, I saw two TV talking heads make the Freudian slip of calling Petraeus "Betray Us."  If the shoe fits the general, then he must wear it -- and the Quisling Congress should try it on for size as well.  As for "The Bitch in the Ditch" Sheehan, I hope the epithet sticks.  It has every bit as much character as "Blood and Guts" Patton or "Stonewall" Jackson.  War leaders -- and antiwar leaders -- earn their nicknames.  In the summer of 2005 she showed us that it was time for the antiwar movement to get down and dirty in Crawford.  Through it all we knew that it was the other side that was mired in the muck.

This dogmatism on pain of death hurt Jewry during the Enlightenment. Christians advanced, while Jews lagged behind.
